NEW DELHI: A Delhi court on Wednesday ordered the closure report of the CBI in 1984 riots case against Congress leader Jagdish Tytler should be put aside and ordered the reopening of the case
The Central Bureau of Investigation (CBI) had earlier a clean chit to Tytler in 2007 and in 2009, saying there was no evidence against him.
However, challenging the closure report filed by the CBI in 2009, Lakhwinder Kaur, whose husband died in the riots, said that the investigating agency had not recorded the testimony of two key witnesses have since riots moved to the United States .
During the discussions, the April 4, the CBI prosecutor had requested the dismissal of the objection filed by the victim saying that the probe has made it clear that Tytler was not present on November 1, 1984 at Gurudwara Pulbangash in North Delhi where three people died during the riots.
The prosecutor said that at the time of the incident, Tytler was at Teen Murti Bhawan, the residence of the then former Prime Minister Indira Gandhi.
Tytler was one of three prominent leaders named in the reports on anti-Sikh riots. Two others were appointed leaders Sajjan Kumar and HKL Bhagat died.
The 1984 anti-Sikh riots, which claimed the lives of nearly 3,000 Sikhs were triggered by the assassination of Indira Gandhi on October 31, 1984 by two of her Sikh bodyguards.
